If the local police enforce federal law over State law, what's the difference?
And that gear will not go to auction. "Civilians" are not allowed to have it. It will be incinerated first. And if it gets too expensive too maintain then you can expect more speed traps and "click it or ticket" and "code enforcement" to boost the revenue and "crime statistics" to justify it.

The survivalist groups teen agers hang out in sometimes have a theme going about a Mad Max survivalist situation. All those small town cops having that gear, and a big economic crash rolls in? Maybe the teen's are not so stupid after all.
